Milan, 10 June (LaPresse) – "I am announcing a new criminal offence concerning the punishment of those who design or fail to implement security measures, or who tamper with the functioning of artificial intelligence systems, where this results in a real danger to the life or safety of individuals or to national security. I would point out that the introduction of these offences does not reflect a pan-penalistic approach, as we have often been accused of, but fills the gaps in protection that arise when new forms of technology become established in reality." This was stated by the Minister of Justice, Carlo Nordio, during a press conference following the Council of Ministers meeting at Palazzo Chigi. "I believe there will be further developments, because we must use our imagination to try to understand what the applications of these extraordinary innovations driven by artificial intelligence might be, which could one day compromise protected assets. Since criminal law is not retroactive, we always run the risk of being left exposed and, therefore, unprotected when, in the face of technological innovations, criminals engage in behaviour that was not foreseen in criminal offences. That is why we must always anticipate as well as prevent," the Minister of Justice then emphasised.
