Libya: Almasri challenges the ICC’s jurisdiction over his case and has lodged an appeal

Rome, 20 May (LaPresse) – Libyan General Osama Almasri has lodged an appeal with the International Criminal Court challenging the admissibility of the proceedings brought against him for alleged crimes against humanity and war crimes, as well as the Court’s jurisdiction. Almasri’s lawyers refer to Articles 17 and 19 of the Rome Statute. The Pre-Trial Chamber of the ICC, which is examining the appeal, in a document signed by President Iulia Antoanella Motoc and Judges Reine Adélaïde Sophie Alapini Gansou and María del Socorro Flores Liera, “takes note of the content and scope of the challenge, which includes both a jurisdictional issue and an issue of admissibility”. And “in order to afford Libya a genuine opportunity to submit observations, and noting that any supporting documentation must, where applicable, be translated into a working language of the Court”, it considers it appropriate “to set 3 July 2026 as the deadline by which Libya and the Office of the Prosecutor must respond to the challenge”. Article 17 of the Rome Statute governs issues relating to admissibility, whilst Article 19 governs preliminary questions regarding the Court’s jurisdiction.
