Almasri case, ICC: ‘Doubts remain about Italy's willingness to cooperate’

Milan, 27 January (LaPresse) – The judges of Pre-Trial Chamber I of the International Criminal Court, by a majority, acknowledge the Italian government's stated commitment to review the rules of cooperation with the ICC, but note that these openings are “subject” to limitations and reservations that cast doubt on Italy's willingness to “cooperate fully”. This is one of the passages in the decision by which the ICC referred Italy to the Assembly of States Parties on the Almasri case. Rome has made cooperation subject to ‘national security interests, geopolitical position and constitutional and domestic legislation,’ ‘arguments that have already been rejected’: ‘domestic law,’ the judges point out, ‘cannot be invoked to justify a failure to cooperate.’ .
