Migrants, EU: "Italy-Albania agreement must comply with European law"

Brussels, Feb 5 (LaPresse) – "When extending the application of national legal provisions implementing EU law to situations outside its scope, Member States must do so in a way that does not undermine or circumvent the application of harmonized rules or the obligations set forth by the Union."

This was stated by European Commissioner for Migration Magnus Brunner in response to a parliamentary inquiry submitted by several representatives from the M5S, PD, and AVS regarding the Italy-Albania protocol and the compliance of migrant transfers to third countries with European law, which had previously been ruled out by the European Commission.

"Regarding Italy’s initiative following the signing of a migration management protocol with Albania, the implementation of this protocol under Italian law must not undermine the common European asylum system or negatively affect EU common rules," the commissioner emphasized.

"It must also complement existing asylum pathways and cannot interfere with the objectives and goals of EU law in this area, nor infringe upon the rights and guarantees that Member States must grant to individuals in such situations," he concluded.
