Justice, FI: "Civil liability of magistrates an indispensable mission"

Milan, June 6 (LaPresse) – "We support the fundamental right of citizens harmed by miscarriages of justice to receive compensation. Making the civil liability of magistrates truly effective means putting the individual, their rights and their freedoms at the center." This was stated in a joint note by the leaders of Forza Italia in the Chamber of Deputies and the Senate, Enrico Costa and Stefania Craxi. "The centrality of the individual is a principle that belongs to the DNA of Forza Italia and its political action, and it is the key through which the issue of the civil liability of magistrates must be addressed. To avoid any misunderstanding, we are not talking about limiting judges' discretion in their rulings, but about serious errors for which people have lost their freedom, jobs, savings and professional and entrepreneurial opportunities, have had their reputations tarnished and have suffered the collapse of their businesses and the disintegration of their families," they added. "In 15 years, only 15 victims of miscarriages of justice have obtained compensation for damages: one per year because of an inadequate law. Is that really possible? In the liberal identity that inspires us, the priority is the protection of citizens and their rights, especially when those rights are violated by the State. Civil liability is not a tool to 'hit' magistrates who make mistakes in their wallets, but a safeguard against injustice. This is why, in our view, setting civil liability against disciplinary liability is not appropriate: these are legal institutions with different natures and purposes. And it must be clear that for Forza Italia, protecting citizens' rights is an indispensable mission," concluded the Forza Italia group leaders in the Chamber and the Senate.
