Security Bill: Greco (CNF): ‘Incentive for lawyers not technically feasible’

Milan, 22 April (LaPresse) – The passage of the Security Decree, which provides for incentives for lawyers but only if the migrant agrees to repatriation, “is not technically possible. Part of my remit is to assess the applicability of the law to the role and activities of a lawyer. And defence lawyers cannot receive remuneration that is contingent upon a specific outcome of their work”. This is stated by Francesco Greco, president of the National Bar Council, in an interview with the daily newspaper La Repubblica. Regarding the new decree promoted by the government to amend the law, “it seems that any link between the defence work carried out by the lawyer and the outcome of their assistance will be removed. So, if that ‘outcome’ clause is dropped, then the entirely unconstitutional possibility of conditioning is overcome,” explains Greco. As for the fact that the Security Decree abolishes legal aid, forcing migrants – who are usually fleeing and have no means of support – to produce documentation of their income, the president of the CNF comments: “Perhaps this is a provision that should be reconsidered.”
