Rome, Jan. 15 (LaPresse) – The Senate gave the go-ahead with 93 yes votes, no votes against and 62 abstentions to legislative decree no. 1315 converting decree-law no. 178 of 29 November 2024, containing urgent measures on justice (the so-called justice decree). The decree, due to expire on 28 January, now passes to the House. Among the measures contained in the decree, which consists of 11 articles, Article 6 contains urgent provisions on prison construction; in particular, the competence of the extraordinary commissioner is limited, excluding it with respect to interventions for which, as of 1 December 2024, the design assignment has already been entrusted. The duration of the commissioner's management is also modified, and it is extended until the end of 31 December 2026 precisely to allow for the complete implementation of the extraordinary plan of prison building interventions. Article 7, on the other hand, deals with control procedures by means of electronic or other technical means, the so-called electronic bracelet. More in detail, it amends Article 275-bis of the Code of Criminal Procedure, specifying that, in the event that the judge has ordered the application of the so-called electronic bracelet in conjunction with the measure of house arrest, the prior verification of the technical feasibility of the use of these instruments by the Judicial Police must also cover the operational feasibility. Article 9 ensures INAIL coverage in favour of persons carrying out community service as a substitute punishment for offences punished with imprisonment of no more than three years.
