Rome, 4 November. (LaPresse) – The Council of State has given the green light for the former Ilva to continue its activities, thereby suspending the TAR ruling. This is according to a statement explaining that 'With Order No. 3992 of 4 November 2025, the Council of State addressed the legitimacy of a decree issued on 7 September 2023 by ARERA. With this act (concerning the activities carried out by Acciaierie d'Italia S.p.A. in certain plants, including those in Genoa, Novi Ligure, Racconigi and the former Ilva plant in Taranto), ARERA had set a deadline for the company to identify the supplier of the gas necessary for the continuation of production activities and the methods of transport. The company, complaining that the deadline set by ARERA was too short, challenged this order before the Lombardy Regional Administrative Court, which rejected the appeal in its ruling no. 3104 of 2025. In examining the appeal by Acciaierie S.p.A., with the aforementioned order no. X of 4 November 2025, the Second Section of the Council of State upheld its request for interim relief, suspended the enforceability of the Regional Administrative Court's ruling, allowed the supply to continue, in order to avoid the interruption of production activities carried out in plants of national strategic interest and the consequent damage to employment, and at the same time set the hearing for 9 June 2026 for the definition of the second instance of the judgment'.
