Milan, May 26 (LaPresse) – The Lazio Regional Administrative Court (TAR) has rejected the appeal filed by unions against Ministerial Decree No. 32 of February 26, which allows families to request the confirmation of a support teacher (for students with disabilities or special needs).

The suspension request was submitted by Flc Cgil and Gilda-Unams, who argued that the provision — allowing for the confirmation of support teachers for the 2025/2026 school year in the same positions they held the previous year — violates the principle of merit that underpins the recruitment process for teachers. According to the unions, it prevents teachers who are well-positioned on official rankings from obtaining temporary contracts in positions that have already been confirmed.

The administrative judges rejected the appeal, explaining that “in this case, the unions do not seem to be acting to protect a common interest of the entire category of teachers, as the appeal concerns issues that may divide the category into conflicting positions.” They added: “Teachers who hope to be confirmed in their current roles have an interest in preserving the contested provisions, and therefore, there is a portion of the teaching category that supports a view contrary to that put forth by the unions.”
