Spain: Shakira wins battle with the tax authorities and will be reimbursed

Madrid (Spain), 18 May (LaPresse) – Colombian star Shakira has won her latest legal battle against the Spanish tax authorities. The National Court, according to a statement, has upheld the singer’s appeal regarding a dispute relating to the 2011 tax year, and has ordered the Spanish authorities to refund her the €55 million paid, plus interest, and to pay the legal costs. According to reports in El País, the total sum to be paid to Shakira exceeds €60 million. The decision, however, does not affect the conviction Shakira already faces for tax evasion relating to the years between 2012 and 2014. The National Court’s ruling establishes that Shakira should not have been considered a tax resident in Spain in 2011. The judges consider, in fact, that it has not been proven that the artist resided in Spain for more than 183 days that year, an essential requirement for being liable to pay tax in Spain. Shakira’s stay that year was 163 days, as noted in the ruling, against which an appeal may be lodged with the Supreme Court. The judges conclude that, as the singer did not have tax residence in Spain in 2011, ‘the penalties imposed on her are unlawful’.
